AIDS: On July 1, 1998, Indiana Senate Bill 374 took effect, allowing a victim of a sexual offense to request a court order that requires the defendant to be tested for HIV. A judge determines if there is probable cause, and results of the test must be kept confidential if the defendant has not been convicted of a crime. The results may be told to the defendant, the victim, the prosecutor, the Department of Corrections, and the counsel for the defendant and for the victim. The victim may also disclose the results of the test through an intermediary to his or her sexual partner or family.
